This Acceptable Use Policy ("AUP") is incorporated into the Master Subscription Agreement, the Sandbox & Demo Terms, and the Website Terms of Use.
1. Prohibited Uses of the Platform
You may not, and may not permit any user or third party to:
- Use the platform in violation of law or of any third-party platform's terms, including the Google Ads API Terms/Policies and the Meta Platform Terms, Developer Policies, and Custom Audience Terms.
- Connect, upload, or process data you lack the right to process, including customer or audience lists, or upload personal information for audience features without all legally required notices and consents.
- Upload or process sensitive/special-category data (government IDs, financial-account numbers, health, biometric, precise geolocation, children's data) except as expressly supported and agreed in writing.
- Reverse engineer or attempt to derive source code, models, data-mapping logic, or algorithms; or use the platform to build a competing product or to benchmark without consent.
- Circumvent usage limits, credit checks, rate limits, or access controls; share credentials; or resell the platform except as permitted.
- Introduce malware; probe, scan, or test vulnerability without authorization; or interfere with integrity, performance, or security.
- Send spam or unlawful marketing, or violate CAN-SPAM, TCPA, or similar laws.
2. AI-Specific Use Conditions
HyprAI is decision-support. You must maintain meaningful human review and are solely responsible for any budget/campaign action you approve or execute. You may not represent HyprAI outputs as professional, financial, or investment advice, or rely on them as the sole basis for material financial decisions. See the HyprAI Addendum.
3. Prohibited Eligibility Uses
You may not use the platform, HyprAI outputs, audience data, or any demographic/audience-breakdown data to make or facilitate decisions about an individual's eligibility for credit, employment, housing, insurance, education, or any other benefit, or for any purpose regulated by the FCRA, ECOA, the Fair Housing Act, or comparable anti-discrimination or consumer-protection laws. The platform is not a consumer reporting agency and its outputs are not consumer reports.
4. Audience / Customer-List Features
If and when audience-upload features (e.g., Custom Audiences) are enabled, you must: (a) upload only lists you have the legal right and consent to use; (b) comply with the destination platform's Custom Audience Terms; and (c) acknowledge that data will be hashed as required by the destination platform before transmission. This capability is not generally available until built.
5. Enforcement & Reporting
Hyprtell may investigate suspected violations and suspend or terminate access, disable connectors, or take other action to protect the platform, customers, or third parties, or to comply with law or platform requirements, with notice where practicable. Report violations or security issues to security@hyprtell.com.
